Overview

This website and online store are operated by JIUMI GLOBAL LIMITED under the Tespara name. Throughout these Terms, we, us, and our refer to JIUMI GLOBAL LIMITED as the merchant responsible for the Tespara store. These Terms apply to your access to tespara.com and to purchases made through the store.

By using the website or submitting an order, you agree to these Terms, the Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, do not use the website or place an order.

Eligibility and customer information

You must have legal capacity to enter into a contract and must provide current, complete, and accurate information. You may not use another person's identity, payment method, address, or contact information without authorization.

Products and descriptions

We aim to describe products accurately. Colors, texture, scale, and appearance may vary because of screen settings, photography, manufacturing tolerances, and natural material variation. Dimensions and weight may be approximate unless expressly identified as exact.

You are responsible for checking product dimensions, weight limits, installation requirements, intended use, pet size suitability, and any warnings shown on the product page or packaging before use. Products must be assembled, installed, maintained, and used according to the supplied instructions. Product information does not replace veterinary or other professional advice.

Prices and payment

Prices and available payment methods are shown at checkout. Applicable tax and shipping charges are shown before order submission where the platform can calculate them. We may correct an obvious pricing, product, or system error before accepting or fulfilling an order. If payment has already been captured and we cannot honor the order, we will cancel the affected item and refund the amount paid for it.

Payment may be processed by Shopify Payments and other payment service providers. We do not receive or store your full payment card number or security code in the ordinary course of checkout processing.

Orders and acceptance

An order confirmation acknowledges that we received your order; it does not necessarily mean the order has been accepted. We may review orders for inventory, payment authorization, fraud, delivery restrictions, pricing errors, or legal compliance. A sales contract is formed when we accept the order by beginning fulfillment or sending a shipment confirmation, subject to any non-waivable rule that provides otherwise.

We may refuse or cancel an order for a legitimate reason, including unavailable inventory, suspected fraud, an unsupported delivery address, product restrictions, or an obvious error. If we cancel after receiving payment, we will refund the affected amount.

Shipping, delivery, returns, and refunds

Shipping estimates, geographic restrictions, delivery requirements, delays, and carrier issues are governed by the Shipping Policy. After delivery, returns and refunds are limited to qualifying seller-responsible product quality issues submitted within the period and under the process stated in the Return and Refund Policy. Tespara does not offer a general change-of-mind, trial-period, or satisfaction-guaranteed return right. Cancellation, non-fulfillment, delivery damage, incorrect items, missing parts, material misdescription, warranty rights, and any mandatory legal remedies are handled as stated in the applicable policies and law. These policies form part of these Terms.

Product safety and pet use

Pet products should be selected and used with appropriate supervision and with regard to the animal's size, age, health, temperament, and behavior. Stop using a product if it becomes damaged, unstable, excessively worn, or unsafe. Keep small parts, packaging, cords, and unsuitable materials away from children and animals. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Product quality and warranty information

Products must be assembled, installed, operated, maintained, and used according to their instructions and stated limits. Tespara is not responsible, to the extent permitted by law, for damage caused after delivery by misuse, impact, scratching, liquid intrusion, unauthorized modification or repair, improper environment, incorrect installation or operation, abnormal voltage, accident, natural disaster, ordinary wear and tear, or another cause unrelated to a seller-responsible product defect.

If a product includes a separate written manufacturer or seller warranty, its terms will be made available on the product page, packaging, or through a clearly identified link. Warranty coverage may vary by product. The remedies and claim process for seller-responsible product quality issues are described in the Return and Refund Policy. Nothing in these Terms excludes or limits a warranty, consumer remedy, or liability that cannot lawfully be excluded or limited.

Intellectual property

The website and its content, including text, graphics, logos, photographs, video, layout, and product presentation, are owned by or licensed to us and are protected by applicable intellectual property laws. You may use the website only for personal, non-commercial shopping and may not copy, scrape, reproduce, distribute, modify, or exploit its content without permission or another lawful basis.

Prohibited use

You may not use the website to violate law, infringe rights, transmit malicious code, interfere with security, obtain unauthorized access, submit false information, conduct fraudulent transactions, or misuse website content or services. We may restrict access where reasonably necessary to protect the store, customers, and third parties.

Third-party services and links

The store relies on third-party services for hosting, payment processing, analytics, communications, and delivery. Third-party sites and services may have their own terms and privacy notices. We are responsible for our obligations to you as the merchant, but we do not control every independent third-party site linked from the store.

Disclaimer and limitation of liability

To the maximum extent permitted by applicable law, the website is provided on an as-available basis and we do not guarantee uninterrupted or error-free access. We do not exclude or limit liability for fraud, willful misconduct, death or personal injury caused by negligence, breach of mandatory consumer rights, or any liability that cannot legally be excluded or limited.

Subject to the preceding sentence, we are not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed. Any limitation applies only to the extent permitted by the law applicable to you.

Indemnity

To the extent permitted by law, you are responsible for loss caused by your unlawful use of the website, fraud, intentional misuse, or infringement of another person's rights. This clause does not require a consumer to indemnify us for our own breach, negligence, or unlawful conduct.

Privacy

Our collection and use of personal information are described in the Tespara Privacy Policy. Shopify and other service providers may process information to operate checkout, payment, fulfillment, security, and other store functions.

Changes to these Terms

We may update these Terms prospectively by publishing a revised version and changing the last updated date. Changes do not retroactively alter an order already accepted unless required by law or agreed with you.

Severability and waiver

If a provision is held unenforceable, the remaining provisions continue to apply to the extent allowed by law. A failure to enforce a provision once is not a waiver of the right to enforce it later.

Governing law and disputes

These Terms and contracts made through the store are governed by the laws of Hong Kong, without depriving you of mandatory consumer protections that apply in your place of residence. The competent courts of Hong Kong will have non-exclusive jurisdiction, unless applicable law requires another forum.
